General conditions of sale for stays in guest rooms

These general conditions of sale are intended for the use of the reservation of stays in guest rooms at
"LACANEPIERE" at GENERAC 30510 in FRANCE. They constitute the reservation contract between the owners, Nathalie and Stephan BARCELO and the customer of a stay in our bed and breakfast.

Article 1 - Duration of stay:

 

The customer signatory of the contract concluded for a fixed period and may not under any circumstances claim any right to remain in the premises. The owner may accept the extension of the stay against payment if the room is free following the planned stay.

 

Article 2 - Conclusion of the contract: 

 

The reservation becomes effective when the customer has sent the owners a deposit of 30% of the total rental amount, or the full payment, i.e. 100% of the rental amount. The payment of the deposit implies the acceptance of the GCS. The reservation concluded between the parties can in no way benefit, even partially, to third parties, natural or legal persons. Prices are inclusive of all charges, with tourist tax.

 

Article 3 - Absence of withdrawal:

 

For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with article L121-21-8 of the consumer code relating in particular to the provision of accommodation services provided. on a date or according to a determined periodicity.

 

Article 4 - Cancellation by the customer:  

 

Any cancellation must be notified by registered mail to the owner.
· If the cancellation occurs more than 30 days before the start of the stay, the deposit and/or payment for the stay will be returned to the customer.
· If the cancellation occurs less than 30 days before the beginning of the stay, the deposit and/or the payment of the stay remain with the owners who reserve the right to claim the balance of the price of the stay.
· If the customer does not appear before 7 pm on the day scheduled for the start of the stay, the owners reserve the right to dispose of their guest rooms. The deposit and/or the payment of the stay remain with the owners who reserve the right to claim the balance of the price of the stay.

Article 5 - Cancellation by the owner: 

 

When, before the start of the stay, the owners cancel the stay, for reasons beyond their control, they must inform the client as soon as possible by telephone or email. This will be refunded immediately of the sums paid. He will also receive compensation at least equal to the penalty he would have incurred if the cancellation had been made by him on that date.

 

Article 6 - Time of arrival: 

 

The customer must present himself on the specified day and at the times mentioned below. The rooms are available from 5:00 p.m. In case of late or delayed arrival, the customer must notify the owner.

 

Article 7 - Time of departure:

Rooms must be vacated no later than 11:00 a.m. After 12 noon you will be charged an additional night.

 

Article 8 - Payment of the balance:

 

The balance is to be paid on arrival at the owner.
Consumption and additional services not provided for will be paid at the end of the stay to the owner. The price of the room is the same for one or two people (breakfast included).
Payments accepted: Check, bank transfer, cash.

 

Article 9 - Tourist tax: 

 

The tourist tax is a local tax that the customer must pay to the owner who then transfers it to the Public Treasury. It is included in the public price. 

Article 10 - Capacity: 

 

2 people maximum for the "Ivoire" and "Pearl" room, 3 people maximum for the "Turquoise" room and 4 people maximum for the "Red" room. The reservation is made for a specific number of people. If the number of customers exceeds this number, the owner is able to refuse the additional customers.
This refusal can in no way be considered as a modification or breach of the contract at the initiative of the owner, so that in the event of the departure of a number of customers greater than those refused, no refund can be considered.

 

Article 12 - Art of living and use of premises: 

 

Respect for a certain art of living is required of all guests to guarantee the tranquility of the place and the comfort of its guests. In addition, LACANEPIERE is a non-smoking area, it is strictly forbidden to smoke in the guest house. The garden is available for smoking. It is also requested not to eat in the rooms.
The customer undertakes to respect the instructions for good manners appearing in the rooms and in these T&Cs. The customer undertakes to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any possible deterioration for which he may be responsible.

Children living within the property are the sole responsibility of their parents.

Outside visitors (parents, children, friends of resident customers) cannot be welcomed within our property (unless exceptional authorization). Any behavior contrary to morality and public order will lead the owner to ask the customer to leave the establishment without any compensation, without any refund, and after payment of the expenses not yet paid. A wifi connection is available to you free of charge. However, the customer remains responsible for all of his downloads.

 

Article 13 - Animals: 

 

Pets are allowed within our property subject to validation by the owners prior to the reservation.

If the agreement has not been given upstream, the owners may reserve the right not to consider reimbursement.

 

Article 14 - Insurance:

 

The customer is liable for all damages caused by him. He must therefore check whether his main residence contract provides for the holiday extension (holiday rental). The tenant certifies that he is covered by civil liability insurance covering his own liability and that of the persons accompanying him.

 

Article 15 - Responsibilities:

 

The photographs presented on our site are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and the texts reproduced to illustrate our Guest House give as exact an overview as possible of the services offered, variations may occur between the time of booking and the day consumption of the service. The owner cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, due to a third party, due to the customer, in particular the unavailability of the Internet network, impossibility of access to the site. web, external intrusion or computer viruses. Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the latter.

 

Article 16 - Data processing and freedoms:

 

In accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you. “L'InstantPresent” undertakes not to transmit the information that you have communicated to it to other companies or organisations.

 

Article 17 - Disputes:

 

These General Conditions of Sale are governed by French law. Only the Court of jurisdiction of the location of the Guest House object of the rental is competent. It is however recalled that the prior recourse to an amicable dispute resolution method is imposed according to the decree of December 11, 2019. Thus, an attempt at an amicable resolution of the dispute must be preferred.

These general conditions of sale are subject to change at any time without notice. Acceptance and compliance with these general conditions of sale are deemed acquired upon payment of the deposit.
